Officer Who Took Down Compliant Suspect Must Stand Trial

A police officer who used an arm-bar takedown of a compliant suspect can be sued for using excessive force on the victim, a federal appeals court held July 12.

The move is used to subdue agitated or violent suspects.

The officer violated Robin Neal’s right to be free from excessive force and the law was clear at the time of the incident, Judge Ralph R. Erickson wrote for the U.S. Court of Appeals for the Eighth Circuit.
