A judge has refused to certify as a class action the federal lawsuit that accuses Lock Haven University of forcing out older employees to avoid paying the retirement benefits they would receive at age 60.

U.S. Middle District Judge Matthew W. Brann Monday ruled the class action motion of Pattiann Merrifield was premature but that she could refile it after discovery is completed.
